Suppose we believe that a property F is coextensive with moral permissibility. F may be, for example, the property of having the best consequences, if we are Consequentialists, or that of conforming to a universalisable maxim, if we are Kantians, and so on. This may raise the following problem. It is plausible that permissibility is “closed under implication”: any act that is implied by a permissible act must itself be permissible. Yet, in some cases, F might not be closed under (...) implication. If that is so, then F cannot be coextensive with permissibility. Maximalism has been proposed as a solution to this problem. A “maximal” act is one not implied by any other act. Maximalism restricts the claim that F is coextensive with permissibility to maximal acts only. A non-maximal act may be permissible without being F if it is implied by a maximal act that is F. The general aim of this paper is to investigate these issues by considering the formal structure of acts, or the “act-implication” relation. Discussions of Maximalism have tended to assume implicitly that acts have structure of some sort, but there has been little careful attention given to this structure. I aim to show that, by thinking about structure, we can provide a stronger defence of Maximalism. (shrink)

In Better Never to Have Been, David Benatar argues that existence is always a harm. His argument, in brief, is that this follows from a theory of personal good which we ought to accept because it best explains several ‘asymmetries’. I shall argue here that Benatar's theory suffers from a defect which was already widely known to afflict similar theories, and that the main asymmetry he discusses is better explained in a way which allows that existence is often not a (...) harm. This paper critically explores the ethical dimensions of Behavioral Public Policy (BPP), a domain grounded in the understanding that human rationality is bounded and that this limitation often leads to behaviors deemed irrational. By applying the behavioral lens, which posits that people operate under bounded rationality, BPP aims to craft interventions that safeguard individuals against their biases. However, this approach raises significant ethical concerns, both in the scientific underpinnings of BPP and its application through policy interventions. Accordingly, this paper examines (...) two distinct ethical dimensions of BPP, both as a scientific discipline and through its intervention methodologies. The analysis of the first dimension argues that, viewing bounded rationality as only instrumental in decision-making processes, risks oversimplifying ethical complexities. Such simplification may ignore the moral and value-based rationalities underlying decisions, potentially misattributing instances of immorality and akrasia (the failure to act according to one's judgment) to mere deficiencies in rational thinking. Secondly, the paper examines the impact of BPP on moral behavior and character development, addressing ethical concerns like the evidentiary basis of BPP research, the bounded rationality of choice architects themselves, and the morality of behavior changes induced by policy. Overall, this article provides a much-needed examination of the moral considerations associated with behavioral strategies in public policy and its epistemological foundations, contributing to a more comprehensive understanding of their ethical implications . Argumentation represents a way of reasoning over a knowledge base containing possibly incomplete and/or inconsistent information, to obtain useful conclusions. As a reasoning mechanism, the way an argumentation reasoning engine reaches these conclusions resembles the cognitive process that humans follow to analyze their beliefs; thus, unlike other computationally reasoning systems, argumentation offers an intellectually friendly alternative to other defeasible reasoning systems. LogicProgrammingisacomputationalparadigmthathasproducedcompu- tationallyattractivesystemswithremarkablesuccessinmanyapplications. Merging ideas from both areas, Defeasible Logic Programming offers a computational reasoning system that uses an argumentation engine (...) to obtain answers from a knowledge base represented using a logic programming language extended with defeasible rules. Recent epistemology has introduced a new criterion of adequacy for analyses of knowledge: such an analysis, to be adequate, must be compatible with the common view that knowledge is better than true belief. One account which is widely thought to fail this test is reliabilism, according to which, roughly, knowledge is true belief formed by reliable process. Reliabilism fails, so the argument goes, because of the "swamping problem". In brief, provided a belief is true, we do not care whether or (...) not it was formed by a reliable process. The value of reliability is "swamped" by the value of truth: truth combined with reliability is no better than truth alone. This paper approaches these issues from the perspective of decision theory. It argues that the "swamping effect" involves a sort of information-sensitivity that is well modelled decision-theoretically. It then employs this modelling to investigate a strategy, proposed by Goldman and Olsson, for saving reliabilism from the swamp, the so-called "conditional probability solution". Drawing on behavioral economics, nudges (policy interventions based on choice architecture) have the capacity to strategically shape policymaking, subtly guiding individual behavior by adjusting their decision environment. Applied to enhance vaccinations, boost retirement savings, or promote healthy habits, these interventions align with consensus-defined well-being. As governments adopt nudges, scholars have explored their role in fostering virtues. This paper argues that nudges have the potential to efficiently contribute to virtuous development by instilling and sustaining habits, respecting individual choice, and ensuring deliberation. (...) The Argument from Inferiority holds that our world cannot be the creation of an omnipotent and omnibenevolent being; for if it were, it would be the best of all possible worlds, which evidently it is not. We argue that this argument rests on an implausible principle concerning which worlds it is permissible for an omnipotent being to create: roughly, the principle that such a being ought not to create a non-best world. More specifically, we argue that this principle is plausible (...) only if we assume that there is a best element in the set of all possible worlds. Cross-cultural comparisons face several methodological challenges. In an attempt at resolving some such challenges, Nathan Sivin has developed the framework of “cultural manifolds.” This framework includes all the pertinent dimensions of a complex phenomenon and the interactions that make all of these aspects into a single whole. In engaging with this framework, Anna Akasoy illustrates that the phenomena used in comparative approaches to cultural and intellectual history need to be subjected to a continuous change of perspectives. Writing about comparative history, (...) Warwick Anderson directs attention to an articulation between synchronic and diachronic modes of inquiry. In addition, he asks: If comparative studies require a number of collaborators, how does one coordinate the various contributors? And how does one ensure that the comparison is between separate entities, without mutual historical entanglement? Finally, how does comparative history stack up against more dynamic approaches, such as connected, transnational, and postcolonial histories? Gérard Colas, for his part, claims that comparisons cannot allow one to move away from the dominant Euroamerican conceptual framework. Should this indeed be the case, we should search for better ways of facilitating a “mutual pollination” between philosophies. Finally, Edmond Eh first asserts that Sivin fails to recognize the difference between comparisons within cultures and comparisons between cultures. He then argues that the application of generalism is limited to comparisons of historical nature. (shrink)

My project in this paper is to extend the interventionist analysis of causation to give an account of causation in psychology. Many aspects of empirical investigation into psychological causation fit straightforwardly into the interventionist framework. I address three problems. First, the problem of explaining what it is for a causal relation to be properly psychological rather than merely biological. Second, the problem of rational causation: how it is that reasons can be causes. Finally, I look at the implications of an (...) interventionist analysis for the idea that an inquiry into psychological causes must be an inquiry into causal mechanisms. Our use of ‘I’, or something like it, is implicated in our self-regarding emotions, in the concern to survive, and so seems basic to ordinary human life. But why does that pattern of use require a referring term? Don't Lichtenberg's formulations show how we could have our ordinary pattern of use here without the first person? I argue that what explains our compulsion to regard the first person as a referring term is our ordinary causal thinking, which requires us to (...) find a persisting object as the mechanism that underpins the causal structure we naturally ascribe to the self. I thus argue against Peacocke's picture (2012), on which it's the cogito that explains one's knowledge of one's own existence. (shrink)

En este artículo presento y analizo el argumento de la igualdad política para defender el impuesto a la herencia de riquezas a partir de la teoría de justicia de John Rawls. Según Rawls, todos los ciudadanos deben tener una oportunidad aproximadamente igual de acceder a cargos de autoridad y de influir en el proceso político. Estas iguales oportunidades se ven amenazadas cuando las desigualdades económicas superan cierto límite. Como las transmisiones hereditarias explican una parte importante de las desigualdades económicas, es (...) necesario un impuesto progresivo a las recepciones hereditarias para evitar concentraciones de riqueza que amenacen la igualdad política. Para prevenir la conformación de dinastías de poder político, este tributo debe incorporar alícuotas agravadas a las transmisiones intrafamiliares y un sistema de progresividad en el tiempo. Mi meta en este ensayo es, primero, reconstruir los puntos de vista de Marcelo Dascal en relación con las controversias filosóficas y, en segundo lugar, someterla a un examen crítico. Dejo en claro que las tesis de Dascal tienen un amplio rango de aplicaciones. Mi crítica se centra alrededor del concepto de conocimiento y de la idea misma de reconstrucción pragmática. Considero también la sugerente conexión que Dascal establece entre las controversias y el progreso intelectual.

La identificación de la denominada dispersión epistemológica en las decisiones en bioderecho se evidencia en la incorporación crítica al materialismo, en particular, y a las nuevas formas de fisicalismo, ya que su base epistemológica se encuentra en un contexto mucho más amplio que la explicación unificadora de la relación mente-cerebro. De ahí que teorías de la argumentación adoptadas por autores como Wroblesky, Aarnio y Alexy identifican una doble exigencia en la justificación: por un lado, la llamada justificación interna, regulada por (...) la lógica a la hora de conectar las premisas o conectar los enunciados que forman parte del razonamiento judicial y, por el otro, la justificación externa, focalizada en los argumentos o razones utilizadas para justificar aquellas premisas o enunciados. El bioderecho implica reconocer que se plantea una crítica al materialismo y al fisicalismo, camino que ya la psicopatología recorrió para entender fenómenos como la intencionalidad, la interpretación de conductas humanas y los supuestos interpretativos de la arquitectura de la decisión jurídica.El estudioso del bioderecho debe identificar esos supuestos, muchas veces irreflexivos; ello implica dar razones acerca de la relación mente-cuerpo subyacente; de los elementos que componen la acción humana jurídicamente relevante; la configuración de los bienes humanos básicos involucrados en la litis en el bioderecho; elementos todos estos que hacen necesario repensar el estatuto cognoscitivo del derecho, en general, y del bioderecho, en particular. This article focuses on the role played by the critique of political economy and Marxian philosophy in the redefinition of Gramsci’s political philosophy during his intellectual moment known as the “return to Marx’’. On the one hand, we show the theoretical importance of the concept of mercato determinato in the formation of notions such as “civil society” and “relations of forces”. On the other hand, the Italian philosopher’s prison revisitation of some of Marx’s works are evaluated; as well as its (...) effects on the revision of certain topics such as the relationship between structure-superstructure or the theory of hegemony. Through an original interpretation of the critique of political economy; and also re-examining the theoretical principles of “historical materialism” in a “philosophy of praxis”, the final aim is to present an interpretation of Gramscian social ontology able to provide a theory on the genesis, reproduction and crisis of a given social formation. The classical limit is fundamental in quantum mechanics. It means that quantum predictions must converge to classical ones as the macroscopic scale is approached. Yet, how and why quantum phenomena vanish at the macroscopic scale is difficult to explain. In this paper, quantum predictions for Greenberger–Horne–Zeilinger states with an arbitrary number q of qubits are shown to become indistinguishable from the ones of a classical model as q increases, even in the absence of loopholes. Provided that two reasonable assumptions are (...) accepted, this result leads to a simple way to explain the classical limit and the vanishing of observable quantum phenomena at the macroscopic scale. In the following pages, I am going to put forward the ethical-philosophical and anthropological keys of Meditations on Quixote. In order to do that, we pay attention to the theory of love in Ortega´s thought in the context of his first and quoted work. Ortega thought carefully about the love following an important philosophical tradition which dates back to classical times in Greece. Ortega was a philosopher and for this particular reason he considered that philosophy is the general science of (...) love; inside the intelectual globe, that represents the great impetus towards an absolute connexion. We try to justify this work in the fact that Ortega´s thought about love and hatred hasn´t been studied taking into account the ethical-philosophical and anthropological theory that appers in Meditation on Quixote. Likewise, it is true that Ortega dialogues, in the contexto of that work, with other authors, such as Sócrates, Plato, Spinoza, Nietzsche or Scheler. We will also study the social and political interferences of his reflection on love in the restoration of the Spanish monarchy. (shrink)

Traditionally, corruption is seen as a rational pursuit of profit, focusing on personal gain. However, this view overlooks behavioral, social, and systemic influences. This paper focuses on the behavioral aspects of corruption, providing a deeper understanding of its complexities by addressing the factors overlooked by conventional approaches. Reviewing some of the literature, we highlight how researchers have approached the study of corruption from the perspective of behavioral sciences. Additionally, we examine how the emerging discipline of Behavioral Public Policy (BPP) employs (...) innovative methods to reduce corrupt practices, offering new insights and strategies that transcend traditional approaches. The core contribution of our paper lies in its novel approach: showing a path for corruption decrease by replacing traditional regulations and bureaucratic burdens, which research shows can increase its likelihood, with non-regulatory behavioral tools such as nudges and sludge audits. By reducing regulations and administrative red tape, these tools simplify processes minimizing opportunities for corrupt behavior in certain contexts, while aligning with liberal principles. In this article, we aim to infuse corruption research with a behavioral twist and a liberal perspective, offering policymakers alternative strategies to foster transparency, accountability, and ethical governance. While this approach will not completely eradicate corruption, it strives to show how BPP can reduce its occurrences. (shrink)

Este artículo se propone analizar las “trampas” de la comunidad en la perspectiva de Bourdieu. Para ello, primero, se señala el legado de Tönnies para la sociología respecto del vínculo entre la comunidad y las relaciones desinteresadas (pasadas, escasas en el presente y emancipatorias futuras). Segundo, se rastrean las profundas críticas de Bourdieu a tal legado, desde su estudio del “interés por el desinterés” enmarcado en sus reflexiones sobre la dominación social y sus eufemismos. Esto se observa en su interpretación (...) tanto de las sociedades no modernas como del desinterés moderno del Estado, con pretensiones de universalidad (por ejemplo, en la lengua unificada y la educación), y de los campos autonomizados y desinteresados de bienes simbólicos, entre los cuales se incluye a la sociología. Por último, las “trampas” que la comunidad encierra emergen en las últimas obras de Bourdieu. Allí, él propugna una intervención política explícita en la cual aparecen tópicos comunitarios y del desinterés, por ejemplo en su llamado a la colaboración entre militantes e intelectuales. Entonces, se vuelve patente una tensión en el autor entre una sociología crítica y reflexiva y la emancipación social. Así, este artículo pretende contribuir a una teoría sobre la comunidad y la dominación social, que tiene implicancias sugerentes para la actualidad. (shrink)
